Šiaurės svajonė MB ("Company," "we," "us," or "our") operates the website at clipanalysis.app and the related analytics features, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, you must not use the Service.
1. Description of the Service
ClipAnalysis.app provides tools for reviewing publicly available social media profiles and content, identifying performance patterns, and producing analytical reports and content insights. The Service is an independent product and is not sponsored by, endorsed by, or affiliated with Instagram, Meta, or any other social media platform.
2. Eligibility and accounts
You must have the legal capacity to enter into these Terms. When creating an account, you must provide accurate information, keep your credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for all activity conducted through your account.
3. Limited right of use
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable right to use the Service for your own lawful personal or internal business purposes. This right does not permit you to sublicense, resell, reproduce, distribute, or commercially exploit the Service itself.
4. Acceptable use
You must not use the Service to:
- violate applicable law, regulation, contractual obligations, or third-party rights;
- access, analyze, or process information where you lack a lawful basis to do so;
- harass, profile, discriminate against, or otherwise harm another person;
- bypass access controls, probe security, reverse engineer the Service, or attempt to obtain its source code except where such restriction is prohibited by law;
- disrupt the Service, introduce malicious code, or impose an unreasonable or automated load on our systems; or
- remove proprietary notices or misrepresent your relationship with us.
We may apply reasonable usage limits or suspend activity that threatens the security, integrity, or availability of the Service.
5. Public social media information
The Service may retrieve and analyze information made publicly available on third-party platforms. Availability, completeness, and accuracy of that information depend on the relevant platform and may change without notice. You are responsible for ensuring that your use of reports and source information complies with applicable law and the relevant platform's terms.
6. Analytical and automated outputs
Reports, classifications, recommendations, and other outputs may be generated or assisted by automated systems. Such outputs can be incomplete, inaccurate, or non-unique and are provided for informational purposes only. They do not constitute legal, financial, medical, or other professional advice. You remain responsible for reviewing outputs and for any decision or content based on them.
7. Intellectual property
The Service, including its software, design, branding, and original content, is owned by the Company or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the Service or of third-party source content to you. If you submit feedback, you permit us to use it without restriction or compensation.
8. Subscriptions, charges, and renewal
Paid features are billed at the price and in the currency displayed when you purchase them. Unless stated otherwise at checkout, subscriptions renew automatically for successive billing periods until cancelled. You authorize our payment provider to collect applicable recurring charges and taxes using your selected payment method.
9. Cancellation and refunds
You may cancel a subscription at any time. Unless mandatory law requires otherwise, cancellation becomes effective at the end of the current paid period and no prorated refund is issued for unused time. Refund requests must be sent to webshared@gmail.com within seven days of the relevant charge. We assess eligible requests individually, without limiting any statutory consumer rights.
10. Third-party services
The Service relies on or may link to third-party platforms, data providers, hosting services, analytics tools, payment processors, and automated analysis providers. We do not control their services and are not responsible for their content, availability, or separate practices. Your use of a third-party service may be governed by additional terms.
11. Service availability and changes
We may modify, limit, suspend, or discontinue any part of the Service. We do not promise that the Service or any particular feature, data source, or report will remain continuously available, secure, or error-free.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in these Terms excludes warranties that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, the Company and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, goodwill, data, or business opportunity, arising from the Service. Our aggregate liability relating to the Service will not exceed the amount you paid us during the twelve months immediately preceding the event giving rise to the claim. These limitations do not apply where liability cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold the Company harmless from third-party claims, liabilities, and reasonable costs arising from your unlawful use of the Service, your breach of these Terms, or your infringement of another party's rights.
15. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk for the Service or others, or where required by law. Provisions that are intended by their nature to survive termination will remain effective.
16. Amendments
We may revise these Terms from time to time. The updated version will be posted on this page with a revised effective date. Where appropriate, we will provide additional notice of material changes. Continued use after the revised Terms take effect signifies acceptance of those changes.
17. Severability
If any part of these Terms is held to be unlawful or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect.
